Guest Policy

The Hotel (means the specific property where you are staying, as identified in your reservation confirmation) is a welcoming environment and does not tolerate discrimination or harassment of any kind. Federal, state, and local laws prohibit discrimination on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, disability, age, or military status. The Hotel is subject to these laws.

Patrons may file a complaint for alleged discrimination with The Hotel’s management.

Terms of Service

These Terms of Service are effective as of 10/20/2025.

THESE TERMS OF SERVICE CONTAIN A MANDATORY ARBITRATION PROVISION. BY USING THE SITE, YOU AGREE THAT CERTAIN DISPUTES WILL BE RESOLVED THROUGH BINDING ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN JURY TRIALS OR CLASS ACTION LAWSUITS. PLEASE REVIEW THE “INFORMAL RESOLUTION; ARBITRATION; WAIVER OF CLASS ACTIONS” SECTION FOR DETAILS.

THESE TERMS OF SERVICE ALSO REFER TO THE HOTEL GUEST AGREEMENT, WHICH CONTAINS A SEPARATE ARBITRATION CLAUSE GOVERNING DISPUTES ARISING OUT OF HOTEL STAYS AND USE OF HOTEL FACILITIES.

Please read these Terms of Service (the “Agreement”) carefully. Your use of the Site (as defined below) constitutes your consent to this Agreement.

Parties; Scope

This Agreement is between you and Miami K Airport Hotel, LLC (“Company,” “The Hotel,” “we,” or “us”), the legal entity that owns and operates The Hotel property identified in your reservation confirmation. It governs your use of this Site (including www.komposehotels.com/miami/ or any successor site maintained for that hotel), along with any materials, services, or features available through the Site (the “Site”).

This Agreement applies regardless of whether you access the Site to make a booking, browse content, or otherwise interact with it. If you make a reservation, the contracting entity is The Hotel property identified in your confirmation, and your stay is additionally governed by The Hotel Guest Agreement and Hotel Policies.

If you are only browsing the Site without making a reservation, the contracting entity is Miami K Airport Hotel, LLC, based in Sarasota, Florida.

Acceptance of Terms

By accessing or using this Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms and conditions that may apply. If you do not agree, you must not use the Site.

Changes

We may change this Agreement by notifying you by any reasonable means, including posting a revised Agreement through the Site. Changes will not apply to disputes arising prior to the posting of the revised Agreement. Your use of the Site following any changes constitutes acceptance of those changes. We may, at any time and without liability, modify or discontinue all or part of the Site; charge, modify or waive any fees; or offer opportunities to some or all users.

Information Submitted Through the Site

Your submission of information through the Site is governed by Company’s Privacy Policy (the “Privacy Policy”). You represent and warrant that any information you provide is and will remain accurate and complete, and that you will maintain and update such information as needed.

Jurisdictional Issues

The Site is controlled or operated (or both) from the United States and is not intended to subject Company to any non-U.S. jurisdiction or law. The Site may not be appropriate or available in some non-U.S. jurisdictions. Any use of the Site is at your own risk, and you must comply with all applicable laws, rules, and regulations. We may limit the Site’s availability at any time, in whole or in part, to any person, geographic area, or jurisdiction.

Rules of Conduct

In connection with the Site, you must not:

• Post, transmit or otherwise make available materials that are or may be: (a) threatening, harassing, degrading, hateful or intimidating; (b) defamatory, libelous, fraudulent or otherwise tortious; (c) obscene, indecent, pornographic or otherwise objectionable; or (d) protected by intellectual-property or other proprietary rights without the express prior written consent of the owner.
• Post, transmit or make available any virus, worm, Trojan horse, time bomb, spyware, or other harmful code.
• Use the Site for any purpose that is fraudulent, tortious, or unlawful.
• Harvest or collect information about users of the Site.
• Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available; or violate any requirement, procedure, or policy of such servers or networks.
• Restrict or inhibit any other person from using the Site.
• Reproduce, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, timeshare, distribute or otherwise exploit any portion of the Site except as expressly authorized herein.
• Reverse engineer, decompile, or disassemble any portion of the Site (except where such restriction is prohibited by law).
• Remove any copyright, trademark, or other proprietary notice from the Site.
• Frame or mirror any portion of the Site, or otherwise incorporate any portion of the Site into any product or service, without our prior written consent.
• Systematically download and store Site content.

No Automated Access; No AI Training. You may not access, scrape, crawl, index, harvest, or copy any portion of the Site by automated means (including bots, spiders, or similar tools) except as permitted by our robots.txt. You may not use any Site content, data, images, or materials to develop, train, or improve any software program, algorithm, or machine-learning or artificial-intelligence model without our prior written consent. Notwithstanding the foregoing, and subject to robots.txt, operators of public search engines may use spiders to copy materials from the Site for the sole purpose of creating publicly available, searchable indices of such materials (not caches or archives). We may revoke such permission at any time.

You are responsible for obtaining, maintaining, and paying for all hardware and telecommunications and other services needed to use the Site.

Products

The Site may make available listings, descriptions and images of goods or services or related coupons or discounts (collectively, “Products”), as well as references and links to Products. Such Products may be made available by Company or by third parties. We do not warrant the completeness, accuracy or timeliness of such listings, descriptions, or images (including features, specifications, prices). Availability, prices, and promotions may change without notice. Colors and attributes may vary by device.

You are responsible for ensuring that your use or purchase of any Products complies with all applicable laws and regulations, including minimum age requirements for hotel stays (21 years of age or older), purchases of age-restricted items (such as alcohol or tobacco, where offered), and any other regulated services or goods.

Transactions

We may make available the ability to purchase or obtain Products through the Site (a “Transaction”). You may be asked to supply information such as credit card number and expiration, billing address and shipping information, and you represent that you have the right to use any card you submit. By submitting such information, you grant us the right to provide it to third parties for purposes of facilitating Transactions. Verification may be required prior to acknowledgment or completion of any Transaction. By making a Transaction, you represent that the Products will be used only in a lawful manner. We may limit quantities, discontinue Products, impose conditions on promotions, bar users from Transactions, and refuse service, in each case without notice. Refunds and exchanges are subject to applicable policies.

The Hotel is fully non-refundable unless stated otherwise on the reservation confirmation.

You agree to pay all charges incurred by you or on your behalf, including taxes and shipping/handling charges.

Stored Payment Information. If you choose to save payment card information in your account, you authorize us to store such information solely for processing future reservations, charges, refunds, and adjustments you initiate. Stored payment information is handled in accordance with PCI-DSS standards and our Privacy Policy. We will notify you of material changes to the use of stored information at the email address you provide.

Registration; User Names and Passwords

You may need to register to use all or part of the Site. We may reject, or require that you change, any user name, password, or other information you provide. Your user name and password are for your personal use only and should be kept confidential; you are responsible for any use or misuse of your credentials and must promptly notify us of any breach or unauthorized use.

Submissions; Feedback; Profiles and Forums

Visitors may make available certain materials (each, a “Submission”) through or in connection with the Site (e.g., profiles, reviews, forums, messaging). Company has no control over and is not responsible for any use or misuse (including distribution) by any third party of Submissions. If you choose to make any of your personally identifiable or other information publicly available through the Site, you do so at your own risk.

License. You retain ownership of your Submissions, but you grant us a worldwide, royalty-free, fully paid-up, non-exclusive, perpetual, irrevocable, transferable, and fully sublicensable license to reproduce, distribute, perform and display (publicly or otherwise), create derivative works of, adapt, modify and otherwise use and exploit such Submissions, in any format or media now known or hereafter developed, and for any purpose (including promotional purposes, such as testimonials). Feedback is deemed a Submission and is non-confidential.

You represent and warrant that you have all rights necessary to grant the foregoing license; that your Submissions are accurate and do not violate law or third-party rights; and you irrevocably waive any “moral rights” with respect to attribution or integrity to the extent permitted by law.

Monitoring. We may (but have no obligation to) monitor, evaluate, alter, or remove Submissions before or after they appear on the Site and may disclose Submissions and related information for any reason.

Company’s Proprietary Rights

We and our suppliers own the Site, which is protected by proprietary rights and laws. Subject to your compliance with this Agreement, and solely for so long as you are permitted to use the Site, you may view one (1) copy of any portion of the Site to which we provide access on any single device for your personal, non-commercial use. All trade names, trademarks, service marks and logos on the Site not owned by us are the property of their respective owners. Nothing on the Site grants any right to use any such marks without prior written consent.

Third-Party Materials; Links

Certain functionality may allow access to materials made available by third parties, including Submissions (“Third-Party Materials”). We neither control nor endorse, nor are we responsible for, any Third-Party Materials. Availability of any Third-Party Materials does not imply endorsement or affiliation. Your use of Third-Party Materials is at your own risk and subject to their terms and policies.

Promotions

From time to time, The Hotel may offer sweepstakes, contests, raffles, surveys, games, or other promotions (collectively, “Promotions”), including on-property activities such as prize wheels or giveaways offered in connection with guest feedback or reviews. Each Promotion will be subject to its own official rules, eligibility requirements, and prize disclosures, which will be provided at the time of the Promotion. Participation in any Promotion constitutes acceptance of its rules in addition to these Terms. In the event of a conflict between the Promotion rules and these Terms of Service, the Promotion rules will control.

Disclaimer of Warranties

The Site and any Products and Third-Party Materials are made available “AS IS” without any warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement and title, to the fullest extent permitted by law. While we try to maintain timeliness, integrity, and security, we do not guarantee the Site will remain updated, complete, correct, or secure, or that access will be uninterrupted. If you become aware of any unauthorized alteration, contact info@komposemiami.com with details.

Limitation of Liability

To the maximum extent permitted by law, Company will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages of any kind under any theory, including for lost profits, data loss, loss of security of Submissions (including unauthorized interception), or inability to use the Site, Products, or Third-Party Materials. Your sole remedy for dissatisfaction with the Site or any Products or Third-Party Materials is to stop using the Site. The maximum aggregate liability of Company for all damages shall be the greater of $10.00 or the total amount, if any, paid by you to Company to use the Site.

Indemnity

Except to the extent prohibited by law, you agree to defend, indemnify and hold harmless Company and the Affiliated Entities from and against all claims, losses, costs and expenses (including attorneys’ fees) arising out of (a) your use of, or activities in connection with, the Site (including Submissions); and (b) any violation or alleged violation of this Agreement by you.

Termination

This Agreement is effective until terminated. We may terminate or suspend your use of the Site at any time and without prior notice. Upon termination, your right to use the Site ceases immediately, and we may deactivate or delete your account and materials without obligation to provide further access. Sections intended to survive (including disclaimers, limitations of liability, indemnity, and governing law) will survive termination.

Governing Law; Jurisdiction; Arbitration

This Agreement is governed by and shall be construed in accordance with the laws of the State of Florida, U.S.A., without regard to conflicts-of-law principles, and regardless of your location.

Except for claims that may be brought in small-claims court or requests for injunctive relief, any dispute arising out of or relating to your use of the Site shall be resolved by final and binding arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Sarasota County, Florida, unless the arbitrator permits remote proceedings. You and Company waive any right to a jury trial or to participate in a class or representative action.

This arbitration provision applies only to disputes arising from use of the Site. Disputes arising from hotel stays, services, or use of The Hotel facilities are governed by the separate arbitration clause contained in The Hotel Guest Agreement, which also applies to all registered guests and their invitees.

You agree to the exclusive jurisdiction of the state and federal courts located in Sarasota County, Florida, for any matters not subject to arbitration, and waive any jurisdictional, venue, or inconvenient-forum objections to such courts.

Copyright Infringement (DMCA) Notices

We respect intellectual-property rights. If you believe content on the Site infringes your copyright, send a notice including all information required by 17 U.S.C. §512 to our designated agent:

Your notice must include: (1) your physical/electronic signature; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and its location (URL); (4) your contact information; (5) a statement of good-faith belief that the use is not authorized; and (6) a statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act. Counter-notices may be sent to the same address as permitted by the DMCA. We may remove content and, where appropriate, terminate repeat infringers.

Filtering

Parental-control protections (hardware, software, or filtering services) are commercially available that may assist in limiting access to material harmful to minors. Information identifying current providers is available from OnGuard Online. We do not endorse any such products or services.

Miscellaneous

This Agreement does not create any partnership, joint venture, employment, agency or franchisor-franchisee relationship. If any provision is found unlawful, void, or unenforceable, it will be deemed severable and not affect remaining provisions. You may not assign this Agreement without our prior written consent; we may assign without restriction. No waiver of any breach shall be deemed a waiver of any other breach. Headings are for convenience only. “Including” means “including without limitation.” This Agreement (including incorporated terms) is the entire agreement between you and Company relating to the Site. Notices to you (including changes) may be made via posting to the Site, email (including links), or regular mail. We are not responsible for any failure to fulfill an obligation due to causes beyond our control.

Hotel Policies

ALL GUESTS, ADDITIONAL OCCUPANTS, AND INVITEES OR VISITORS ARE BOUND BY THE HOTEL GUEST AGREEMENT AND THESE HOTEL POLICIES. ALL DISPUTES ARISING FROM YOUR STAY OR USE OF THE PROPERTY ARE SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTIONS, AS SET FORTH IN THE GUEST AGREEMENT.

For purposes of these Policies, “the Hotel” means the specific property where you are staying, as identified in your reservation confirmation.

Check-In & Check-Out

• Check-in: 4:00 PM.

• Early Check-In (subject to availability; on-site requests only): Not guaranteed and handled at the front desk on the day of arrival based on room availability and housekeeping status. If accommodated, fees apply per room: $75 + tax before 10:00 AM; $45 + tax between 10:00 AM–2:00 PM; $15 + tax between 2:00 PM–4:00 PM. These rates apply only to on-site requests; no fee is charged if early check-in cannot be accommodated.

• Check-out: 11:00 AM.

• Late Check-Out (subject to availability; on-site requests only): Not guaranteed and handled at the front desk on the day of departure. If accommodated, a $35 + tax fee per room applies for departures up to 2:00 PM. No extensions beyond 2:00 PM are available; occupancy after 2:00 PM will be charged as an additional night at the prevailing rate.

• Late Arrival: Guests must check in by 12:00 a.m. (local time) on the arrival date or contact the hotel in advance. Failure to do so is a no-show: the reservation (including multi-night stays) is cancelled and non-refundable.

• These Hotel Policies and The Hotel Guest Agreement apply to all registered guests, additional occupants, and any invitees or visitors permitted on property. Guests are responsible for their invitees’ compliance.

Data & Payment Security

• All card transactions are processed securely in compliance with PCI-DSS 4.0 standards.
• The Hotel does not store sensitive card details on its systems and works only with vendors who maintain recognized information-security certifications, including SOC 2 Type II and GDPR compliance where applicable. See our Privacy Policy for details.

Guest Conduct & Quiet Hours

• Guests must behave respectfully toward staff and other guests.
• Quiet hours are 10:00 PM – 8:00 AM. Excessive noise, disruptive behavior, unauthorized parties, or violations of local law may result in eviction without refund.
• Firearms, weapons, explosives, and hazardous items are strictly prohibited on property, consistent with applicable law.
• Registered guests are responsible for the conduct of all invitees/visitors and any minors in their party.

Damages & Incidentals

• A $150 incidental authorization is processed per booking at check-in.


• This authorization cannot be transferred or applied to future or separate reservations, even if made under the same guest’s name or payment method.


• Guests are financially responsible for all damages to hotel property. If the cost of repair, deep cleaning, replacement, or lost room revenue exceeds the incidental authorization, the excess amount will be charged to the card on file

Smoking

• The Hotel is a non-smoking property. A $250 fee will be charged for violations. Designated smoking areas are available—please ask staff.

Pets

• Pets up to 50 pounds are welcome. Larger pets are not permitted on property.
• A non-refundable pet fee applies per stay, payable at check-in.
• Guests are responsible for damages, noise disturbances, or additional cleaning caused by pets.

Valuables

• The Hotel is not liable for the safety or loss of valuables left unattended in rooms or public areas. Safes may not be provided in all rooms; guests assume responsibility for personal belongings.

Payment & Declines

• The credit card used to make the reservation will be charged the full stay amount on the morning of arrival. If the card is declined, the reservation will be cancelled.
• If a guest card is declined during the stay, the guest must pre-pay all remaining or additional room nights, the incidental hold will be doubled to $200, and extras may no longer be charged to the room without prepayment.
• The card used must match the reservation name. Incidentals authorization must be on a single card.
• Guests agree not to dispute valid charges for stays or incidentals. The Hotel reserves the right to contest any chargebacks and recover costs through legal or collection processes.

Key Cards & Access

• Only registered guests with valid photo identification will be issued additional key cards or be allowed access to rooms by management if a key card is lost.

Lost & Found

• Personal items left behind are kept for up to 30 days from the date of discovery. After that, items may be donated or discarded.
• Guests requesting returns are responsible for shipping costs, delivery arrangements, and all risks of loss or damage during transit. The Hotel is not liable for unclaimed property.

Luggage Policy

• Each guest is permitted up to one standard suitcase and two personal items (such as handbags or backpacks). Oversized bags, large containers, or trash bags are not permitted. Management reserves the right to enforce luggage limits for safety and storage reasons.

Maximum Occupancy

• Each guest room is subject to maximum occupancy limits set by hotel policy and local fire code. Exceeding occupancy is prohibited and may result in eviction without refund.

Transient Occupancy

• Stays are transient accommodations only and do not create tenancy or rights under the Florida Residential Landlord and Tenant Act.

Third-Party Services

• Certain amenities or services (e.g., restaurants, valet, deliveries) may be operated by independent third-party providers. The Hotel is not responsible for the acts, omissions, or services provided by such parties.

Deliveries & Package Acceptance

• We accept up to three (3) packages per room per stay complimentary; additional packages are $5 each (plus tax).
• ID is required for pickup. We accept deliveries starting 3 days before arrival and hold items for 3 days after check-out.
• Items may be refused if unsafe, oversized/heavy, perishable, improperly labeled, COD, or if storage space is unavailable.
• The Hotel is not an insurer of packages and is not responsible for loss, theft, misdelivery, delay, or damage caused by carriers or third parties. Guests must pursue carrier claims directly.

Amenities & Facilities

• Use of amenities (including but not limited to pool/spa/sauna/lazy river/mini-golf/gym/pickleball) is at your own risk and subject to posted rules and the Guest Agreement. No lifeguards are provided. Children must be actively supervised by an adult. Violations may result in loss of access or eviction.

Medical Recovery Policy

• The Hotel is not a medical or post-surgical recovery facility. Guest rooms are for lodging only and may not be used for medical procedures, recovery activities, or disposal of medical waste (including sharps or clinical materials).
• Proper attire is required in all common areas. Guests may not appear in common areas wearing robes, surgical garments, or with visible bandages, drains, or medical devices.
• If staff reasonably believe a violation is occurring, they may enter the room for inspection after knocking and announcing. Additional cleaning or biohazard remediation fees may apply.

Surveillance

• The Hotel uses CCTV in common areas for guest safety. Footage may be shared only with law enforcement or as required by law.

Health Notice (COVID-19 and Communicable Illnesses)

• By visiting or staying at the property, guests acknowledge that exposure to communicable illnesses (including COVID-19) may occur in any public setting. The Hotel takes reasonable efforts to mitigate risks; however, risk cannot be fully eliminated. To the maximum extent permitted by law, guests assume such risks and release The Hotel, the property owner/manager, and their affiliates from related claims.

Cancellation Policy

• Reservations are non-refundable unless stated otherwise on the reservation confirmation. No-shows are charged the full price of the room.

Arbitration & Waiver of Class Actions

• Disputes arising from your stay are subject to binding arbitration and a waiver of class actions, as detailed in The Hotel Guest Agreement. By using this site or staying at the property, you agree to these terms.

Conflict of Terms

• In the event of any conflict between these Hotel Policies and The Hotel Guest Agreement, the Guest Agreement shall control. These Hotel Policies are intended to supplement, not replace, the Guest Agreement.

Management Rights

• Management reserves the right to add, alter, or amend policies at any time, and to refuse service or evict any guest for violations of these policies without refund where permitted by law.
